There's much to see here. These are exhibits submitted in district court in Portland, OR to prove that the movie PAGEASTER was copied from my work at a public access TV station in Portland over the summer of 1992, based on a synopsis I submitted to an excutive at News Corp in New York in the fall of 1991. Included below is the District Judge's ruling that the case be denied on summary judgement, and that no trial before a jury was necessary. The legal standard for analysis the judge was following was the so called 'ordinary, reasonable observer' test, used in the 9th Circuit to vet copyright claims. This involves a detailed examination of the 'extrinsic' or outward similarities in the works, and requires only that an 'ordinary reasonable observer' could believe the works were copied. A single paragraph conclusion, such as is displayed in this judicial opinion, is considered an insufficient degree of analysis in 9th circuit case law. On appeal, this legal standard was similarly ignored for some reason. In short, I never had the chance to present my case to a jury, so i'm asking you to be the jury I never had. 

So, take your time, and go through these examples of alleged copying. The  Judge had asked for 15-20 examples, and I provided 23 example. I could probably point out a hundred examples of alleged frame copying from memory, and I believe this was an end to end process, with the total number of copied frames of video in the neighborhood of 700-1,000 as story board for both the live action and animated segments of the movie. What's important to keep in mind,, is that you are the ultimate judge and the ultimate jury. As an 'ordinary reasonable observer', if you believe these examples could have resulted from copying, you are not merely disagreeing with the Judge's opinion denying a trial, you will have flatly disproved it.
